General Terms and Conditions for Consumers

Article 2. Scope of These Terms

These general terms and conditions apply to any work offered for sale by Charlotte Jonckheer, including custom-made works. By placing an order or accepting a quotation from Charlotte Jonckheer, the Buyer agrees to these General Terms and Conditions.

Orders from abroad may be refused if Charlotte Jonckheer is unable to ship to the destination country or comply with the local legal requirements.

The parties may deviate from these terms and conditions only if expressly agreed in writing.



Article 3. The Agreement

Prices offered by Charlotte Jonckheer are subject to change at any time.



When a purchase agreement is concluded remotely the provisions of Chapter II, Book VI of the Belgian Economic Law Code regarding distance contracts apply. Consequently, the Consumer has the right of withdrawal within 14 working days.



Article 4. Price and Payment

The prices stated online exclude VAT and other costs such as taxes, shipping, and transport fees. The Consumer will receive an overview of theshipping costs and associated VAT when providing a delivery address.

Charlotte Jonckheer reserves the right to suspend the processing or delivery of any order if a payment by credit card is declined by the officially accredited organisations or in the event of non-payment. In particular, Charlotte Jonckheer reserves the right to refuse to make a delivery or fulfil an order placed by a customer who has not partially or fully paid for a previous order or with whom a dispute concerning payment is ongoing.

Failure to pay the invoice suspends all obligations of Charlotte Jonckheer. Charlotte Jonckheer retains full ownership of the works until the invoice is paid in full. 

Article 5. Delivery and Transfer of Risk and Ownership

Products ordered through the webshop will be delivered inside Belgium and the EU within 15  working days. Should a delivery exceed 15 working days or become impossible Charlotte Jonckheer will inform the customer without undue delay.

Shipping is always at the risk of Charlotte Jonckheer. The risk of loss or damage to the work passes to the Consumer when the Consumer or a designated third party physically receives or inspects the delivered work. If the work is damaged, does not correspond to the order, or if there are other complaints, the Consumer must report this within 7 days to Charlotte Jonckheer.

The Consumer is entitled to statutory guarantees under the Consumer Sales Act. If a non-conformity, present at the time of delivery, manifests within two years, the Consumer is entitled to repair or replacement. Any compensation resulting from this can never exceed the amount invoiced to the Consumer. Ordinary wear and tear, accidental or intentional changes made by the Consumer to the work, inability to present an original invoice or valid proof of payment, and various forms of negligence are explicit but not exhaustive exceptions to the aforementioned guarantee system.

Article 6. Characteristics of the Work

Due to the artisanal nature, specific materials, and uniqueness of each work, Charlotte Jonckheer cannot guarantee that the colors and shapes shown on the website, social media, catalog, or shared designs accurately reflect reality. These images are for illustrative purposes only.



            How to: Maintenance and Handling?

The materials used are subject to changes over time due to exposure to light, humidity, or age, which may result in fading or weathering of colors, patinas, etc.



These conditions must always be communicated to a new owner in case of resale. Charlotte Jonckheer accepts no liability towards any subsequent owner. The Consumer is responsible for complying with all (national) information obligations and safety regulations.



Article 7. Intellectual Property

Charlotte Jonckheer retains all copyrights, except for the right to exhibit the work in a manner that does not harm her honor or reputation. Consequently, the Buyer is not permitted to adapt or reproduce the physical work, in whole or in part, through any medium, nor to have it adapted or reproduced by third parties. The purchase of the work does not imply any transfer of copyrights held by Charlotte Jonckheer, except as specified in Article XI.173 of the Belgian Economic Law Code.



            When can you share images of my work?



Charlotte Jonckheer grants the Buyer the right to photograph or film the work and share such images publicly for the purpose of resale. The images may not be exploited in any other way. They must not harm the integrity of the author or the work, either through their context, quality, or representation.



            How can you help me?



The Buyer agrees to notify Charlotte Jonckheer in writing if they become aware of copyright infringement by a third party.



            How to attribute my name?





The name "Charlotte Jonckheer" shall remain associated with the work. The Buyer must ensure that the name "Charlotte Jonckheer" is always credited when the work is referenced or displayed, leaving no ambiguity regarding the authorship of the work.



            What if  Repairs and Replacements are necessary?



If the product or parts of it require repair or replacement, the Buyer must contact Charlotte Jonckheer to respect her moral rights.



Article 8. Liability



Charlotte Jonckheer cannot be held liable for any error, except in the case of gross negligence, intentional misconduct, death, or personal injury. Charlotte Jonckheer is not responsible for loss or damage except in the case of gross negligence or intentional misconduct by herself or her agents.



Article 9. Applicable Law and Dispute Resolution


Belgian law applies at all times, without prejudice to the Consumer’s protection under the mandatory provisions of the law of the country where the Consumer has their habitual residence.



Article 10. Personal Data



Personal data will only be used for the execution and delivery of the order and will never be shared with third parties. After one year, this data will be permanently deleted, except for information required to be retained for accounting or legal purposes. The Consumer has the right to request access, modification, or deletion of their personal data. Charlotte Jonckheer is responsible at all times for protecting and safeguarding this data.



Article 11. Returns & refunds



The customer has the right within a period of 14 days from the date of receipt of the original order to request an exchange or return the goods purchased by writing to us by email at info@charlottejonckheer.com

The customer must return the goods to be exchanged or refunded, in its/their original condition, within 14 days of the exchange request through mail.

The goods must be returned in its/their original packaging, to the following address:
